At least it was intellectually consistent when pre-nuptial agreements were void for “public policy” in favour of marriage. Now you are allowed to make an agreement, but a judge decides later which clauses you can rely upon. It’s the very opposite of the Rule of Law, which was England’s greatest gift to the world.
Absolutely sickening. I have seen a friend go through the family courts and was horrified. I admit I was pretty smug about English Law having practised it for thirty years and having seen good reliable work from commercial judges and arbitrators. The courts that serve the masses however – from what I have recently seen – are a disgrace. Nor is it due to laziness, sloppiness or error IMHO. It’s ideological and deliberate.
